BOE Meeting for March 22, 2005

1. Proclamation: Cesar Chavez Day, March 31, 2005

Background: On March 31, 2005, we commemorate Cesar Chavez and recognize him as a great leader who injustice and created a coalition for civil rights that was unprecedented in this state's history.

The Board approved the proclamation.

2. Approval of Boys & Girls Club Lease Agreement

Background: At the July 21, 2004 BOE Meeting, the executive director for the Boys and Girls Club made presentation to the Board. That presentation include plans to relocate the Boys and Girls Club to space on the Woodstock campus.

In order to move forward with these plans, AUSD and the Boys and Girls need to agree on a lease agreement. The proposed lease agreement was presented for the Board's review at the meeting. Major provisions include AUSD's free use of the gymnasium during school hours and Boys and Girls Club use of the land for $1 a year.

The Board approved the lease.

3. Academic Performance Index (API) Report

Background: The Academic Performance Index (API) continues to be central focus of the California State Testing and Accountability system.

Staff presented the statewide similar school rankings for 2004.

4. Resolution No. 05-3938 Intent to Dismiss Classified Employees, California School Employees Association, Office/Tech Unit

Item Type: Action (15 minutes)

Background: At the February 8, 2005 BOE Meeting, the Board approved Spending Reductions totaling $1,625,000.

As a result, the District must give notice employees impacted by the budget reductions. The following positions have been identified:

  • Accounting Assistant II, Fiscal Services, 1.0 FTE
  • Accounting Assistant III, ROP/Secondary Education, .125 FTE
  • CWA Specialist, Student Services, .125 FTE
  • Personnel Specialist, .25 FTE
  • Staff Secretary I, Educational Services, .25 FTE
  • Textbook Technican, Encinal High, 1.0 FTE

Staff recommended the resolution be amended to remove the Textbook Technican and plans to bring back a new recommendation for the reduction of one FTE at Encinal.

Board member Gibson requested the removal of the .125 FTE for the Child Welfare and Assistance position.

The Board approved the resolution.

5. Resolution No. 05-3939 Intent to Dismiss Classified Employees, Local One

Background: At the February 8, 2005 BOE Meeting, the Board approved Spending Reductions totaling $1,625,000.

As a result, the District must give notice employees impacted by the budget reductions. The following positions have been identified:

  • Truck Driver, Maintenance, Operations and Facilities, .125 FTE
  • Two (2) Gardeners, Maintenace, Operations and Facilities, .33 FTE each
  • CWA Specialist, Student Services, .125 FTE
  • Custodian, Bay Farm Elementary, .25 FTE
  • Custodian, Chipman Middle, .25 FTE

The Board approved the resolution.

6. District Redevelopment Revenue Report

Background: The Community Improvement Commission of the City of Alameda (CIC) and the Alameda Unified School District (the District) entered into an agreement on November 12, 1991 pursuant to the Community Redevelopment Law of the state of California (Health and Safety Code, Section 33401). The purpose of the agreement is to provide a certain portion of the tax increment from the Business and Waterfront Improvement (BWIP) to be transferred to the District (District Housing Fund). The funds will pay for the cost of low and moderate-income housing projects or programs carried out by the District. In addition to the provisions of this agreement, monies are also subject to the applicable Community Redevelopment Law, the City's Housing Element of the General Plan and the agreement resulting from the Clayton Guyton and Modesa Henderson v. City of Alameda action.

Over the past serveral months, the District has met with City staff to explore possible projects the District could undertake with the current accumulated funds available. After reviewing options, the District's staff direction is to develop existing school property. In doing so, the District will have ownership of an asset that will appreciate in value over time.Pursant to the agreement, the District has to present to the CIC the project or list of projects in order to access the funds. The timeline for the project has been extended by the City from March 1 to April 1 of the current year.

The District intends to submit its project to the CIC by April 1, 2005.

33401. The agency may in any year during which it owns property in a redevelopment project that is tax exempt pay directly to any city, county, city and county, district, including, but not limited to, a school district, or other public corporation for whose benefit a tax would have been levied upon the property had it not been exempt, an amount of money in lieu of taxes that may not exceed the amount of money the public entity would have received if the property had not been tax exempt.

Measure A Exception: The City Council agreed in the Settlement Agreement on the Guyton vs. City of Alameda case that Section 26-2 of the City Charter allows the Alameda Housing Authority to replace, with multi family housing, 325 low cost housing units. Three hundred and twenty five represents the number of low cost units lost when the former Buena Vista Apartments were converted to Bridgeport Apartments. The City agreed that the 325 units of multi family housing can be built at densities allowed as of January 1, 1990, even if Zoning and General Plan changes are subsequently adopted which reduce allowable densities.

7. Approval of Second Interim Report

Background: The Second Interim Report was presented for the Board's review.

Because the District may not meet its financial obiligations for the two subsequent fiscal years, the Report will be submitted as "Qualified". If the Board fails to take action by the end of the year to address 2005/06 reserve requirements, a fiscal advisor will be appointed in the Fall.

The Board approved the second interim report.
