Language Provisions of the Tentative Agreement

Article 4 District Rights

The Association agrees that there will be no strike or other form of work stoppage during the term of this agreement.

Article 5 Leaves

Wording to allow the use of sick leave for Famliy Medical Leave Act (FMLA) and the California Family Right Acts (CFRA) for family illness not otherwise covered under FMLA and CFRA.

Article 8 Teaching Hours

This article received the most attention of the negotiations teams. The entire article has been rewritten so the best way to determine the changes will be to compare the prior article from the old contract to the new contract. In the interim, here is a summary of the highlights:

  • The professional day remains.
  • Prep periods shall be self directed assigned site time for teacher use and discretion for professional activities. Site administrators retain the discretion to meet with teachers during their perparation time on occasion.
  • The creation of a technology committee to neogotiate the impacts, if any, of the use new technology.
  • Fourth and Fifth grade classroom teachers shall receive one additional in lieu day per trimester.
  • In-lieu time must be used by the end of the school year.
  • Extra duties agreements contained in existing side letters were incorporated into the contract. In addition, a 14 hour limit was extended to include elementary school teachers with an evaluation after the 2004/05 school year.

Article 13 Safety

A sub committee is updating this article is expected to complete its work by the end of 2004.

Article 17 Peer Coaching

The mentor teacher program (which in now expired) is replaced with Peer Coaching language. There six sections of language.

Article 27 Special Education

A sub committee of three teachers and three administrators will develop recommendations for changes to this article.

Article 28 Peer Assistance Review

In future years, teachers will be paid hourly for hours worked not to exceed 35 hours per person per year.

Along with these language changes, there were changes with a fiscal impact cover under the major provisions review section.
