Borikas/Beery Case Update

June 26, 2009

On March 17, the judge in the Borikas case denied the plantiff's motion for summary judgment. AUSD issued a press release where Board President McMahon speaking on behalf of the Board reiterated the Board's commitment to vigorously defend Measure H. The next hearing is scheduled for July 9th.

For those wondering the impact on Measure H items, the District issued a statement in early September. The District is using the law firms of Chapman, Popik & White LLP and Foley & Lardner LLP to defend the lawsuits. The district spent approximately $190,000 in legal fees in 2008/09 fiscal year defending Measure H.

The Alameda Education Foundation has published a layperson's guide to the Measure H lawsuits.
